Enforcement and Bankruptcy Law
Whether you are a creditor trying to recover a debt or a debtor facing an enforcement file, timing matters enormously in this area of law — a payment order not objected to in time, or a seizure not challenged within the statutory period, can produce consequences that are difficult to undo. Anyone searching for an enforcement lawyer in Fethiye is generally looking for support with exactly this kind of time-sensitive process. Aysel Atlı Law and Consultancy Office advises both creditors and debtors.

The creditor initiates enforcement proceedings for the debt owed.

A payment order is served on the debtor.
- 03Objection Window
The debtor has a short statutory window to object.
- 04Seizure or Resolution
If unpaid and not successfully objected to, the file proceeds to seizure of assets.

Enforcement Proceedings With and Without a Court Judgment
Enforcement proceedings based on a court judgment ("ilamlı") are more straightforward for the creditor and limit the debtor's ability to object; proceedings without a prior judgment ("ilamsız"), based directly on the creditor's claim, give the debtor a right to object within a short statutory period. Choosing the right type of proceedings from the outset affects both the speed and cost of recovery.
Objecting to Enforcement Proceedings
A debtor who objects to a payment order within the statutory period suspends the proceedings; the creditor must then either bring a case to have the objection set aside (for cheque/promissory-note cases) or a case to have the objection annulled through the ordinary courts. Missing the objection deadline allows the proceedings to become final and exposes the debtor's assets to seizure.
Seizure of Assets and Statutory Exemptions
Once enforcement proceedings become final, the creditor can request seizure of the debtor's assets. Turkish law exempts certain assets that are necessary for the debtor's and their family's basic subsistence from seizure, in whole or in part; which assets qualify depends on the specific facts.
Cheque and Promissory Note Enforcement
Debts based on a cheque or promissory note (collectively, "kambiyo senedi") benefit from a faster, specialised enforcement procedure, with different objection periods and a different process for setting aside an objection compared with ordinary debt claims. Starting proceedings under the correct procedure matters for how quickly the claim can be resolved.
Concordat: An Alternative to Bankruptcy
Concordat allows a debtor company facing genuine, good-faith payment difficulties to reach an agreement with a qualifying majority of creditors to restructure its debts, with court approval making that agreement binding on all creditors. It offers a route to avoid bankruptcy while allowing the business to continue operating, which can be particularly relevant for businesses in Fethiye's seasonal tourism economy that face temporary cash-flow pressure outside the high season.
Rent Arrears and Eviction
Where a tenant falls behind on rent, the landlord can combine a claim for the unpaid rent with a request for eviction in the same enforcement file, allowing both the recovery of the debt and the return of the property to be pursued together.
Frequently Asked Questions
What happens if I do not object to a payment order in time?
The enforcement proceedings become final, and the creditor can proceed to request seizure of your assets. This is one of the most consequential deadlines in enforcement law, so prompt action matters.
Can a foreign national be a party to enforcement proceedings in Turkey?
Yes; nationality does not change the basic framework, though practical matters such as service of documents and, where relevant, powers of attorney need to be handled correctly.
What assets are protected from seizure?
The law protects certain assets needed for the debtor's and their family's basic subsistence, in whole or in part; the exact scope depends on the type of asset and the debtor's circumstances.
How is concordat different from bankruptcy?
Concordat allows the business to continue operating while its debts are restructured with creditor and court approval, whereas bankruptcy results in liquidation of the debtor's assets.
Can enforcement proceedings be pursued for a relatively small debt?
Yes; the amount of the debt affects which procedure makes the most economic sense, but enforcement proceedings are not limited to large claims.
Does an objection to enforcement proceedings stop the debt from growing?
The objection suspends the enforcement steps themselves, but it does not, by itself, resolve the underlying dispute over whether the debt is owed — that is determined in the follow-up court process.
